Terms and Conditions for Report Political Violence

These Terms and Conditions (“Terms”) are a binding agreement between you (“User,” “you,” or “your”) and Report Political Violence (“Report Political Violence,” “we,” “us,” or “our”). By accessing, using, or submitting through the Services, you agree to these Terms. If you do not agree, you must immediately discontinue use.
1. Definitions
- “Services”: The Report Political Violence website, platforms, submission forms, payment processing, and all related features.
- “Submission”: Any content, data, files, documents, or materials you provide.
- “Verification Fee”: The mandatory payment required to process a Submission.
- “Forwarding Entities”: Government agencies, employers, organizations, political figures, or other third parties to whom Submissions may be delivered.
2. Eligibility & Restrictions
2.1 You must be 18 or older and legally competent to enter into contracts.
2.2 Use of the Services is prohibited where restricted by law.
2.3 We reserve the right to deny or revoke access to anyone for any reason.
3. Nature of Services
3.1 Report Political Violence is a privately operated, civilian-led reporting channel.
3.2 We are not a government agency and make no guarantee of investigation, enforcement, or outcome.
3.3 You acknowledge that forwarding of Submissions is at our sole discretion.
4. User Submissions & False Reports
4.1 You are solely responsible for your Submission.
4.2 By submitting, you affirm your Submission is accurate to the best of your knowledge and free from malicious intent.
4.3 Prohibited Submissions include:
- False, fabricated, or misleading reports.
- Defamatory, harassing, or abusive content.
- Unauthorized use of copyrighted or proprietary materials.
- Malware, spyware, or malicious code.
4.4 Knowingly false reports may be forwarded to law enforcement, and you may be held civilly and criminally liable.
4.5 All Submissions, including unpaid or incomplete ones, may be retained in permanent archives.
5. Payments & Fees
5.1 Each Submission requires a non-refundable Verification Fee unless otherwise mandated by law.
5.2 Payment processing is handled by third-party vendors. Report Political Violence is not liable for errors, delays, or breaches arising from third-party payment processors.
5.3 Attempted chargebacks or fraudulent payments may result in reporting to law enforcement or collection agencies.
6. License & Ownership of Submissions
6.1 By submitting, you grant Report Political Violence an irrevocable, perpetual, worldwide, royalty-free license to collect, reproduce, transmit, store, disclose, and forward the Submission.
6.2 You waive any claims of ownership or control once submitted.
6.3 We may redact, edit, or format Submissions prior to forwarding.
7. Intellectual Property
7.1 All branding, software, design, text, logos, graphics, and functionality are owned by Report Political Violence.
7.2 Unauthorized reproduction, scraping, framing, or reverse engineering is strictly prohibited.
7.3 Report Political Violence complies with the DMCA. Copyright owners may issue takedown requests.
8. Prohibited Conduct
- Use the Services for illegal, defamatory, or abusive purposes.
- Impersonate another individual or misrepresent your affiliation.
- Exploit or resell the Services without authorization.
- Attempt to gain unauthorized access to Report Political Violence systems.
9. Privacy & Data Disclosure
9.1 Use of Services is governed by our Privacy Policy.
9.2 Report Political Violence may disclose records, Submissions, and user data in response to lawful subpoenas, court orders, or governmental requests.
9.3 Anonymity is not guaranteed; payment records and IP addresses may be linked to Submissions if required by law.
10. No Warranty
10.1 Services are provided “as is” and “as available.”
10.2 We disclaim all warranties, express or implied, including merchantability, fitness for purpose, and non-infringement.
10.3 We do not warrant:
- (a) accuracy or completeness of Submissions;
- (b) results or actions taken by Forwarding Entities;
- (c) uninterrupted or secure operation.
11. Limitation of Liability
11.1 To the maximum extent permitted by law, Report Political Violence shall not be liable for:
- Any reliance on Submissions;
- Actions taken or not taken by Forwarding Entities;
- Damages from delays, errors, or service interruptions;
- Indirect, consequential, or punitive damages.
11.2 If liability cannot be waived, total damages shall not exceed the lesser of:
- (a) the Verification Fee paid, or
- (b) $50 USD.
12. Indemnification
You agree to indemnify and hold harmless Report Political Violence, its officers, directors, employees, and contractors from claims, damages, liabilities, or costs arising from:
- Your use of Services,
- Your Submissions,
- Your violation of these Terms,
- Your infringement of third-party rights.
13. Dispute Resolution & Arbitration
13.1 All disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA).
13.2 Location: Texas.
13.3 You waive the right to jury trials and class actions.
13.4 Costs of arbitration shall be shared equally, unless otherwise ordered.
14. International Use
14.1 Services are controlled from United States.
14.2 Users accessing from outside are responsible for compliance with their local laws.
15. Force Majeure
We are not liable for delays or failures caused by circumstances beyond our control, including natural disasters, war, terrorism, cyberattacks, pandemics, or government restrictions.
16. Termination
16.1 We may suspend or terminate Services at any time, without notice.
16.2 Termination does not affect sections relating to liability, indemnification, or intellectual property.
17. Record-Keeping & Evidence
17.1 All Submissions, including metadata, may be logged, timestamped, and archived as part of compliance and auditing.
17.2 Report Political Violence reserves the right to provide such records as evidence in legal, regulatory, or investigative proceedings.
18. Governing Law
These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles.
19. Severability
If any provision is deemed invalid, the remainder shall remain enforceable.
20. Waiver
Failure to enforce any clause shall not constitute a waiver of rights.
21. Assignment
You may not assign or transfer these Terms. Report Political Violence may assign rights and obligations without restriction.
22. Survival
Sections relating to Submissions, Payments, Intellectual Property, Indemnification, Limitation of Liability, and Arbitration survive termination.
23. Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement between you and Report Political Violence.
